An NYPD cop struggling with bipolar disorder committed suicide after he was made to work the graveyard shift, court documents claim.

Benitez had been working the overnight shift monitoring video cameras in a Brooklyn housing project when he died, the New York Post reports.

He had been diagnosed with mental health issues several months before and his family claims the police department was aware of his condition.

The suit states his mental health treatment required quality sleep and a regular routine.

Benitez graduated second in his class and was a former track and field star.

He leaves behind a one-year-old son.

His family is seeking full death benefits in the lawsuit because Benitez ‘died on the job based on emotional stress negligently caused by the NYPD’.
