The police officer accused in the drowning of his 11-month-old son was found not guilty of injury to a child.
On Thursday, the judge dropped two of the three charges he faces.
Judge Susan Larson acquitted Raymond Licon Jr. on charges of abandoning and endangering a child and criminal negligent homicide.
Prosecutors asked Larson to reconsider.
Licon was facing a reckless injury to a child charge in the death of his 11-month-old son, Azrael Ezekiel Licon, who died when Licon allegedly left him unattended in a bathtub with the water running last year.
While on the stand, Licon said he was on the phone with the mother of his children when he heard something going on with his daughter downstairs of their northeast apartment. Licon said he went to check on her and left the baby in the tub.
Attorney Tom Hughes was happy with the judge’s decision to acquit Licon of two charges.
